In plain language. We send you email you asked for, email that is needed to run our relationship with you, and, where the law allows it or you agree, news and invitations. Every marketing email says who we are, gives our postal address and has a working unsubscribe link. Unsubscribing takes one step, needs no login and is honored promptly. We do not buy or rent email lists, and we do not sell your address. If an Elysium customer emails you through our platform, that customer is the sender and is responsible for the message.
1. Scope
This Email Policy explains how Elysium Innovative Labs LLC, operating as Elysium Ecosystem (“Elysium”, “we”, “us”), sends email and how you can control it. It covers:
- Part A: email that Elysium sends for its own purposes (Sections 2 to 10); and
- Part B: email that Customers send through the Elysium platform to their own contacts (Section 11).
It supplements our Privacy Policy, Cookie Policy, Messaging Terms and Terms of Use.
2. The types of email we send
| Type | Examples | Can you opt out? |
|---|---|---|
| Transactional and relationship | A reply to your inquiry; scheduling a demonstration you requested; contract, billing and account notices; security alerts; important changes to our terms or policies | You may not opt out of messages needed to administer an existing relationship or to reply to what you asked for, but you can tell us to stop initiating contact |
| Marketing | Newsletters, insights and articles, product and company news, event and webinar invitations, offers | Yes, at any time, from any message |
| Business outreach | A first message to a business contact whose work address is publicly available or supplied by a lawful source, about a service relevant to their role | Yes, at any time. Where the law requires consent first, we ask for it first |
3. How we obtain addresses and consent
We collect email addresses when you contact us, subscribe, register for an event or become a Customer, and from lawful business sources such as publicly available business listings, event organizers and referrals. We do not buy, rent or use harvested or “scraped” address lists, and we do not send to addresses we have generated by combining names and domains.
Our practices follow the strictest law that applies to the recipient’s location:
| Region | Rule in outline | What we do |
|---|---|---|
| United States | The CAN-SPAM Act lets commercial email be sent without prior consent if it is truthful, identifies itself as an advertisement, includes a valid physical postal address and offers a working opt-out that is honored within ten business days. State laws, such as California’s, additionally ban deceptive headers and subject lines | We meet each of those requirements. We prefer consent for newsletters and event marketing, and we do not send to anyone who has opted out |
| Canada | CASL requires express consent or valid implied consent before sending a commercial electronic message, sender identification including a mailing address, and an unsubscribe mechanism that is honored within ten business days. Implied consent lapses (for example, six months after an inquiry, two years after a purchase). The business-contact exception applies only where the address was conspicuously published without a no-solicitation statement and the message is relevant to the person’s role | We obtain express consent, or rely on implied consent only within its limits, keep the proof, and identify ourselves in every message |
| European Economic Area | ePrivacy rules, together with the GDPR, require opt-in consent for email marketing to individuals, subject to a narrow exception for a seller’s own similar products or services to existing customers, with a simple opportunity to refuse. Some countries, such as Germany and Austria, require prior consent for business recipients as well | We use a clear, unticked opt-in that is separate from other terms, and we send only what you agreed to. In countries that require consent for business recipients, we obtain it |
| United Kingdom | PECR, as amended by the Data (Use and Access) Act 2025, requires consent for marketing to individuals, subject to a similar “soft opt-in” for existing customers. Corporate subscribers (companies and other corporate bodies) may be sent unsolicited marketing, but sole traders and some partnerships are treated as individuals, and every recipient can object | Same as the EEA. We also give a right to object with every message |
| Australia | The Spam Act 2003 requires the recipient’s express or inferred consent, accurate sender identification and a functioning unsubscribe facility that is honored within five business days | We meet these requirements and honor opt-outs within five business days for Australian recipients |
| Brazil, Mexico and other countries | Data-protection and consumer-protection laws such as the LGPD and Mexico’s federal data-protection law, and local rules on advertising, require a lawful basis and an easy opt-out | We apply the strictest applicable standard and a clear opt-out |
4. What every marketing email from Elysium contains
- an accurate “From” name and address, “Reply-To” and routing information, sent from a domain that we own or control;
- a subject line that reflects the content of the message and is not misleading;
- a clear indication that it is an advertisement or marketing message where the law requires one;
- the name of Elysium and our valid physical postal address (7901 4th St N, St Petersburg, FL 33702);
- a clear, conspicuous unsubscribe link, and the standard one-click unsubscribe header (RFC 8058
List-Unsubscribe-Post) that mailbox providers require for bulk marketing; - a link to this Email Policy and our Privacy Policy.
5. Our email practices
- Unsubscribe is simple. You never need to log in, pay, or provide more than your email address to unsubscribe. The link keeps working for at least 60 days after we send a message.
- Prompt processing. We stop marketing email as soon as we can, and no later than ten business days after your request (five business days for Australia). We do not sell, rent or transfer your address after you opt out, except to a service provider that helps us comply with your request.
- Suppression. We keep a suppression record so that an opt-out is not undone by a data import or a list refresh. If you opt out on one list, we treat it as an opt-out from all Elysium marketing email to that address, unless you tell us otherwise.
- Frequency. We aim to send no more than four marketing emails per month to any address.
- Authentication and security. We use standard sender-authentication controls (SPF, DKIM and DMARC), transport encryption where the receiving server supports it, and monitor bounces and spam complaints so that we stop sending to addresses that bounce or complain.
- Consent records. We keep records of when, where and how consent was given and withdrawn, and of the wording shown, for five years after the last message.
- Third parties. We do not use another party’s list, and we do not permit others to send email on our behalf without written agreements that require compliance with this Policy.
6. Tracking in email
Some Elysium marketing emails include a tiny image (a tracking pixel) and links that identify you by a unique code. We use them to tell whether a message was delivered, opened or clicked, to understand which content is useful and to improve it. Mail features such as Apple Mail Privacy Protection may load images automatically, so an “open” is not always a person reading. Where the law requires consent for this technology, we obtain it before we track. You can avoid tracking pixels by turning off automatic image loading in your email application, and by unsubscribing. See also the Cookie Policy.
7. Unsubscribing and managing preferences
- Use the unsubscribe link at the bottom of any marketing email or the unsubscribe button that your email application displays.
- Or email privacy@elysiumecosystem.com or write to us through the contact page, from the address you want removed if possible.
- You can also ask us for access to, correction of or deletion of your data, and object to processing, as described in the Privacy Policy.
- Unsubscribing from marketing does not stop transactional messages such as replies to your requests, security alerts or notices about your contract.
8. Security and sensitive information
Email is not a secure way to send sensitive information. Please do not send health information, patient information, payment card numbers, passwords or government identification numbers to us by email unless we have agreed a secure channel with you in writing. Healthcare organizations that need to exchange protected health information with Elysium do so under a business associate agreement and through the encrypted channels we designate; see the Health Information Notice.
Recognizing genuine Elysium email. We will never ask you for your password or a payment by return email. Genuine emails come from addresses at elysiumecosystem.com. If a message claims to be from Elysium but looks suspicious, do not click its links or open attachments, and forward it to security@elysiumecosystem.com.
9. Reporting spam or abuse
If you receive an email that you believe violates this Policy or the law, forward it, with full headers, to support@elysiumecosystem.com. We investigate every report and take action, including suspending senders, where appropriate. You may also complain to the U.S. Federal Trade Commission, your national data-protection or communications regulator, or your mailbox provider.
10. Your data
How we collect, use, retain and protect email addresses and related data is described in our Privacy Policy. In summary, we use your address to communicate with you as this Policy explains, we do not sell it, and we keep consent and suppression records for the periods stated there.
11. Part B: Email sent through the Elysium platform
The Customer is the sender. When an organization uses Elysium’s Services to send email to its own contacts, that Customer, and not Elysium, is the sender and controls the content and the recipients. Elysium acts as its service provider and processes the email on the Customer’s instructions. If you have questions about a message, or want to unsubscribe from one, contact the Customer that sent it and use the unsubscribe link in the message. To report abuse of our platform, write to support@elysiumecosystem.com.
What Customers must do. By using email features, each Customer agrees, at its own responsibility, to:
- send only to recipients who have consented in accordance with the law that applies to them, or where a lawful exception applies, and keep proof of that consent;
- not use purchased, rented, scraped, harvested or shared lists, and not send to role addresses or addresses obtained without the owner’s permission;
- follow the CAN-SPAM Act, CASL, the GDPR and ePrivacy rules, UK PECR, the Australian Spam Act and every other law that applies to its messages, including by using accurate headers and subject lines, identifying itself as sender, including a valid postal address and providing a working, one-step unsubscribe that it honors within the legal deadline, and one-click unsubscribe for bulk marketing;
- authenticate its sending domains with SPF, DKIM and DMARC, and keep its spam-complaint rate below the thresholds set by mailbox providers (currently below 0.3 percent, with a goal of under 0.1 percent);
- maintain list hygiene, suppress hard bounces, complaints and opt-outs, and honor them across every system it uses;
- not send content that is illegal, deceptive, fraudulent, phishing, malicious, sexually explicit or promotes unlawful goods and services, and not impersonate others;
- for healthcare organizations, avoid protected health information in email content unless the message is encrypted or the patient has agreed to the risk, and have a business associate agreement in place with Elysium before any protected health information is processed; and
- comply with the Services Agreement and any acceptable-use requirements in it.
We may throttle, block or suspend email sending, immediately and without liability, if we detect violations, receive complaints, or are directed to by a mailbox provider or authority.
12. Changes to this Policy
We may update this Policy to reflect legal, technical or business changes. We will post the new version with an updated date and, if the change materially affects your rights, tell you directly and obtain your consent again where the law requires.
