In plain language. We text or call you only if you have given us permission that meets the law. Consent is never a condition of buying anything. Reply STOP at any time to end text messages and HELP for help. Message and data rates may apply. We do not share your mobile number or your text-message consent with anyone for their marketing. If an Elysium customer (for example, a clinic or a restaurant) messages you through our platform, that customer is the sender and is responsible for having your consent.
1. Scope
These Messaging Terms apply to text messages (SMS, MMS and similar), telephone calls (live, prerecorded and AI-generated voice) and other direct messaging sent by or through Elysium Innovative Labs LLC, operating as Elysium Ecosystem (“Elysium”, “we”, “us”). They cover two situations:
- Part A: Elysium’s own messages. Messages that Elysium itself sends to you (the “Elysium Program”, Sections 2 to 13).
- Part B: Messages sent through the Elysium platform. Messages that an organization that uses Elysium’s Services (a “Customer”) sends to its own contacts (Section 14). The Customer, not Elysium, is the sender of those messages.
These Terms supplement our Privacy Policy, Terms of Use, Email Policy and Health Information Notice. If you sign a written agreement with us for the Services, that agreement governs your use of the Services and prevails over these Terms where they conflict.

3. Consent
Consent is voluntary and not a condition of purchase. You do not have to agree to receive text messages or automated calls to buy anything from us, to use the Website or to receive our services.
How you can give consent. You consent when you take a clear, affirmative action that refers to text messages, such as:
- checking an unchecked box on a web form that is separate from your acceptance of our terms and privacy policy, and submitting your mobile number;
- texting a keyword to a number we publish for that purpose;
- giving written consent, on paper or electronically, that includes the disclosures below; or
- giving verbal consent that we record with your knowledge.
What we tell you when we ask. The request for consent identifies Elysium as the sender, describes the type and frequency of messages, states that message and data rates may apply, explains how to opt out and get help, and links to these Terms and our Privacy Policy. For promotional texts we obtain your prior express written consent, including your acknowledgment that messages may be sent using automated technology. Our standard wording is:
By checking this box and submitting your mobile number, you agree to receive recurring text messages from Elysium Ecosystem Communications (Elysium Innovative Labs LLC) at the number provided, including messages sent with automated technology, about your inquiry and, if you have chosen it, about news, events and promotions. Consent is not a condition of any purchase. Message frequency varies (up to 4 promotional messages per month). Message and data rates may apply. Reply STOP to cancel and HELP for help. See our Messaging Terms and Privacy Policy.
Double opt-in. We may text you to confirm your choice and ask you to reply YES. If you do not confirm, we send nothing further other than to reply to a message you initiated.
Your number. You confirm that the number you give us is yours or that you are authorized by its owner to consent. If your number changes or you give it up, please tell us. We check reassigned-number databases where available, and we stop messaging a number when we learn it belongs to someone else.
Records. We keep a record of each consent and opt-out (the number, the date and time, the source, the wording you saw and its version) for five years after the last message, to demonstrate compliance.
4. Message content and format
- Every automated text identifies Elysium as the sender.
- We send links only on domains we own or control, and not through public link-shortening services.
- We do not send content that carrier rules prohibit, and we do not use messages to collect payment card details, government identifiers or health information.

5. Costs
We do not charge you to receive our messages. Your mobile carrier may charge for messages and data under your plan, and you are responsible for those charges. Roaming and international rates may be higher.
6. How to opt out
You may withdraw consent at any time, by any reasonable means:
- By text: reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE or OPTOUT, in upper or lower case. Federal regulators treat words such as “stop”, “quit”, “end”, “revoke”, “opt out”, “cancel” and “unsubscribe”, and a plain-language message with the same meaning, as valid requests.
- By other means: tell any Elysium representative, call us, email support@elysiumecosystem.com, or use the contact page. You do not need to use a particular word or channel, and we will not require you to do more than one thing.
What happens next. We stop sending you text messages immediately when we can and in any event within the time the law allows, which is no more than ten business days. We may send one final message confirming your opt-out. If your reply is unclear, we may send a single clarifying message within five minutes, for example to ask whether you want to stop all messages or only a particular kind, and we send nothing else unless you answer.
Scope. We treat an opt-out as applying to all automated marketing and informational text messages from Elysium to that number. Opting out of text messages does not change your choices about email (see the Email Policy) or telephone calls.
To resubscribe after opting out, reply START or UNSTOP, or opt in again through one of the methods in Section 3. We will not resubscribe you without a new affirmative action.
7. Help
Reply HELP to any message, or contact us at support@elysiumecosystem.com or through the contact page. Our reply gives our name and contact information and explains how to opt out.
8. Carriers and delivery
The Elysium Program is available on major U.S. and Canadian wireless carriers, and support may change by carrier. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your device, network, coverage and settings, and we do not guarantee that any message will arrive or arrive on time. We comply with the codes of conduct of mobile carriers and the CTIA Messaging Principles and Best Practices.
9. Times of day and frequency limits
We send marketing texts and calls only between 8:00 a.m. and 8:00 p.m. in the recipient’s local time, which is stricter than the federal 8:00 a.m. to 9:00 p.m. window and meets the shorter windows of states such as Florida, Maryland, Oklahoma and Washington. We also observe other state limits, including days-of-week restrictions, that apply to the recipient’s location. Two-way conversational replies to a message you send may occur at any time. Where we cannot determine your time zone, we use the most restrictive assumption.
10. Do-not-call and suppression
We maintain an internal do-not-call and do-not-text list, and we honor requests to be added to it at any time. We scrub marketing lists against the U.S. National Do Not Call Registry and applicable state lists unless you have given us your express written consent or another lawful exemption applies. Suppression records are kept so that we do not contact you again.
11. Privacy of mobile information
Your information is handled as described in our Privacy Policy. In particular:
- We do not sell, rent or share your mobile number or your text-message opt-in data and consent with third parties or affiliates for their marketing or promotional purposes.
- All the categories of information collected in connection with this program exclude text-message originator opt-in data and consent, which will not be shared with any third parties.
- We share your number and message content only with service providers, such as messaging aggregators and carriers, that deliver our messages for us and only for that purpose, and where the law requires.
12. Calls, AI-generated voice and recording
- Types of calls. We may call you live, with a prerecorded message, or with an AI-generated voice. U.S. regulators treat AI-generated voices as “artificial” voices, so we place such calls only with the prior express consent (and, for marketing, prior express written consent) that the law requires, and we do not use them for any purpose you have not agreed to.
- Disclosure. At the start of any call that uses an AI-generated voice or assistant, we tell you that it is automated. We identify Elysium and give a call-back number, and we give you a simple way to end further calls, which we honor.
- Recording and transcription. If we record or transcribe a call, we tell you at the start and give you the option to object or to end the call. We follow the all-party consent laws that apply in the states where the people on the call are located.
- Caller ID. We transmit accurate caller identification and do not spoof numbers.
13. Health information and emergencies
Text messages and standard voicemail are not secure, and they are not for emergencies. In an emergency, call your local emergency number (911 in the United States and Canada). We do not ask you to send health information by text, and you should not. Where a healthcare organization uses the Services to message its patients, see Section 14 and the Health Information Notice.
14. Part B: Messages sent through the Elysium platform
The Customer is the sender. When an organization uses Elysium to send texts, make calls or run automated conversations to its own contacts, that organization, and not Elysium, decides who is contacted and what is said, and is the “sender” or “originator” for the purposes of the Telephone Consumer Protection Act, carrier rules and comparable laws. Elysium acts as the Customer’s service provider and processes the messages on its instructions. If you are a recipient, the Customer’s identity appears in the message. To exercise your rights, contact the Customer, or reply STOP: replies are processed automatically for the Customer’s number. If you have a complaint about a message sent by a Customer, or believe a message is abusive or unlawful, write to support@elysiumecosystem.com.
What Customers must do. By using messaging features, each Customer agrees, at its own responsibility, to:
- obtain and document, before the first message, the consent required by law for each recipient and each type of message, including express written consent for marketing and automated or AI-voice calls, using clear disclosures of the sender’s identity, the purpose, the frequency, that rates may apply and how to opt out, and links to its terms and privacy policy. Consent must not be bundled with unrelated terms, purchased, rented or borrowed, and must be specific to the Customer;
- register its business and each messaging campaign with carriers as required (including Application-to-Person 10DLC brand and campaign registration, toll-free verification or short-code approval), and describe the use case, opt-in method and sample messages accurately;
- include the sender’s name in each message, support the keywords STOP, HELP and their equivalents, honor opt-outs immediately and in any case within ten business days across all systems it uses, and never re-message someone who has opted out without a new affirmative opt-in;
- send only within permitted hours, observe federal and state do-not-call and quiet-hours rules, and respect frequency limits;
- keep consent and opt-out records for at least five years;
- send no content that is illegal, deceptive or fraudulent, or that carriers prohibit or restrict, including content involving adult material, hate speech, illegal or federally restricted drugs including cannabis, firearms, tobacco and vaping, unlawful gambling, pyramid schemes, phishing, or unlicensed high-risk financial products, or that impersonates another person or organization;
- comply with the CAN-SPAM Act, CASL, the GDPR and ePrivacy rules, and any other law that applies to its messages and recipients;
- for AI-generated or prerecorded voice, obtain consent that covers those technologies and disclose the automated nature of the call at the outset; and
- for healthcare organizations, use messaging only in ways that comply with HIPAA and applicable state law, limit the content of messages to the minimum necessary, avoid including protected health information in unencrypted messages unless the patient has agreed in writing to that risk, and have a business associate agreement in place with Elysium before any protected health information is processed.
Enforcement. Carriers, aggregators and regulators may block or filter traffic and impose fines. We may suspend or restrict messaging, immediately and without liability, if we receive complaints, detect violations, or are directed to by a carrier or authority, and a Customer is responsible for fees and penalties its messaging causes. The Services Agreement contains the Customer’s full terms.
15. Other countries
Where we message people outside the United States, we do so only as local law permits. In Canada, we send commercial electronic messages only with express or valid implied consent, we identify ourselves, and every message has a working unsubscribe mechanism that we honor within ten business days (CASL). In the European Economic Area and the United Kingdom, we send electronic marketing by text only with your opt-in consent, except where a narrow existing-customer exception applies and you can object easily and free of charge at every message (ePrivacy and PECR, as amended by the Data (Use and Access) Act 2025). In Australia, the Spam Act 2003 requires consent, sender identification and an unsubscribe facility. Comparable rules apply in Brazil, Mexico, India and elsewhere, and we follow them.
16. Changes to these Terms and to the program
We may change these Terms or the Elysium Program from time to time, for example to reflect new laws or carrier requirements. We will post the updated Terms with a new date and, where the change materially affects your rights, tell you by text or email and obtain your consent again where the law requires. If you continue to receive messages after an update, you accept the update; you can opt out at any time.
17. Disclaimers and limits of liability
To the fullest extent permitted by law, messaging is provided on an “as is” and “as available” basis, and we are not liable for delayed, failed, misdirected or undelivered messages, or for charges your carrier makes. Sections 16 (Disclaimer of warranties) and 17 (Limitation of liability) of the Terms of Use apply to these Terms. Nothing here limits any right you have under law that cannot be waived, including your rights under the Telephone Consumer Protection Act.
